Before the hearing

Arrive early

Plan to be inside the building 30 to 45 minutes before the calendar starts. Parking, the security line, and finding the department all take longer than you expect. If your case is called and you're not there, the judge can enter judgment against you.

What to bring

Government photo ID, every notice the landlord gave you, the summons and complaint, your lease, rent receipts or bank records, dated photos of conditions, and every text and email with the landlord printed out with dates showing. Bring three copies of anything you want the judge to see. Bring your phone but keep it silent and put away.

How to dress and act

Dress as you would for a job interview. In the courtroom, stand when the judge enters, speak only when asked, and address the judge as "Your Honor." Never argue with the landlord or their attorney, however untrue what they're saying is; your attorney will respond. Judges decide credibility in minutes, and composure is most of it.

What an unlawful detainer calendar looks like

Eviction calendars are crowded. The clerk calls the list; landlord attorneys check in and tell the court which cases are settled, which need a short trial, and which need a longer setting. Before trial the judge usually sends both sides into the hallway or a settlement room to talk; most cases resolve there. A trial to the judge typically takes 20 to 60 minutes; a jury trial is set for another day. The judge often rules from the bench.

The sheriff, and what "five days" means

If the landlord wins, the sheriff posts a notice giving you five days to leave; after that, deputies can physically remove occupants and the landlord changes the locks. A stay of execution for a short additional period is sometimes granted on request. Never wait for the sheriff to negotiate; the best move-out deals happen before judgment.
